What Is a Compliance Review of Marketing Materials?
A compliance review of marketing materials is the internal process an RIA uses to check advertising content — websites, social posts, pitch decks, and client communications — against Marketing Rule requirements before it’s published or distributed.
The SEC expects firms to have a documented process for this review, typically overseen by the Chief Compliance Officer, with records showing what was reviewed, when, and by whom. This isn’t a one-time policy statement — examiners look for evidence the review actually happens consistently, including for smaller or informal content like social media posts and email newsletters.
A well-structured review checks for compliant use of testimonials and endorsements, proper performance presentation, accurate representation of credentials and services, and required disclosures.
